General trading conditions of the Sorttex GmbH

1. General
The Sorttex GmbH sells residual items from its supply of enterprises with valid trading licence. For all contracts, supplies and achievements of the Sorttex GmbH the following general trading conditions excluding (AGB) are valid; we contradict deviating regulations of the contracting party hereby expressly. This AGB is a component of the sales contract. All special agreements require the written confirmation on our part.

2. Contract conclusion
Our data at goods and prices within the order procedure are not-binding and noncommittal. With your order you deliver a binding offer. Immediately after the order you keep an email, which confirms contents of your order. We are entitled to accept an offer of the customer within one period of three working-days. If we should not be able to accept your offer exceptionally, then we inform you immediately of it by email. Otherwise your offer is valid at expiration accepted of three working-days than of us.
Should if an article, which you wanted to order, to be not available, we are entitled to solve us from the contract obligation to the supply; we commit ourselves at the same time to inform you immediately about the unavailability and to refund received returns immediately.

3. Payment options and prices
All prices mentioned understand themselves net, zzgl. the legal VAT. from stock Hamburg.
Payments are to be paid against advance payment by transfer on our bank account to carry out or in cash during collection. Therefore a supply, or collection of the commodity is only possible after according to registered receipt of payment.

4. Delivery
Delivery is available on request and is done through a shipping or parcel prior to individually agreed terms.

5. Warranty and Liability
If delivered articles obvious material or manufacturing defects, including transport damages are, or by the delivery quantity vereibarten differ, so you complain to us such errors within 3 working days. We deal exclusively with Restposten, so close we warranty claims in the legal sense. In all cases of breach of contractual or statutory breach of duty precontractual and we are only liable for intent or gross negligence.
In the case of a merely negligent breach of duty by us or our agents, we are only liable for the breach or non-fulfillment of essential contractual obligations, and only to the typical foreseeable contractual damage.

Your data will not be disclosed to third parties. The necessary transaction data is stored. Furthermore, address and ordering information for our own marketing purposes and processed. 8. Final clauses
If individual regulations of the contract including these regulations should be totally or partly ineffective or, or should the contract a regulation gap contain, the effectiveness of the remaining regulations or parts of such regulations remains untouched.
